SUNRISE 1: SR1 : First-come-first-served
The .ASIA doesn’t expect a large amount of requests during this period, consequently, the .ASIA won’t receive many application forms for the same domain name. The attribution of a domain name will be done on a first-come-first-served basis.
SUNRISE 2 and SUNRISE 3:
In order to avoid the chaotic race for their domain names and to preserve a calm, rational and equitable process, DotASIA decided to proceed to an auction between the qualified applicants when a domain name received more than one qualified application.
The application forms submitted during the SR2 and the SR3 will be checked as the same time. Then, the qualified applicants will start the auction process and they will be invited to raise in price on the domain name.
At the end of the verification process, all the qualified applicants will be notified. The whois information and the information about the trademark’s prior rights (which give the eligibility to an applicant) will be supplied to all the qualified applicants.
BIDDER’S ELIGIBILITY
An applicant will be consider as an eligible bidder on a domain name if the relevant documents and the fees fit the registration process, if they are been submitted before the dead line and if they are been trough the verification process successfully. The decision made about the eligibility or the non-eligibility of an applicant is not related to the applicant’s legal rights on a registered name, on a registered trademark or to his intellectual property rights.
If a bidder contests the eligibility of another qualified applicant, he has to inform the registry and start a legal procedure before the beginning of the auction. Each bidder is responsible to defend his rights in court. In the case of a conflict between eligible bidders, the registry could suspend the auction until the dispute resolution.
AUCTIONS:
The auction will be private, only the eligible bidders will be allowed to participate.
